Terms and Conditions

1. Introduction
Welcome to VITYL 3DCP Decor, a Limited Liability Company ("LLC"). By placing an order or engaging in any services with VITYL 3DCP Decor ("we," "us," or "our"), you ("the customer") agree to the following terms and conditions. Please read these terms carefully before placing an order.

2. Custom Decor Orders
VITYL 3DCP Decor specializes in creating custom decor products. All orders are custom-made based on the specifications provided by the customer. By placing an order, the customer agrees that they have reviewed the design specifications, including dimensions, colors, and materials, and approve the design as finalized. Any modifications to the order must be communicated and approved before production begins. Changes made after the commencement of production may incur additional fees.

3. Deposits and Payments
A 50% deposit is required for all large orders. The deposit is non-refundable once the production process begins. The remaining balance must be paid in full upon completion of the product, prior to pickup or shipping. For smaller orders, full payment is required at the time of placing the order.

4. Shipping and Handling
VITYL 3DCP Decor does not handle shipping directly. Customers may arrange for shipping through a third-party carrier. We recommend using reputable carriers for the safe handling of custom decor products. If the customer requests, we can recommend a shipping carrier, but all arrangements, contracts, and payments for shipping are the customer's responsibility.

5. Risk of Damage and Liability
Once the product has been handed over to the customer or a third-party shipping carrier, VITYL 3DCP Decor is not liable for any damages, breaks, or defects caused during transportation or subsequent handling. It is the customer’s responsibility to inspect the product upon receipt. If damage occurs during shipping, it must be reported directly to the carrier. VITYL 3DCP Decor ensures that all products leave our premises in high-quality condition, as per the agreed-upon specifications.

6. Refunds and Cancellations
Due to the custom nature of our products, refunds are not available once production begins, except in cases where VITYL 3DCP Decor fails to fulfill the agreed specifications. If the customer decides to cancel an order before production begins, the deposit may be refunded at the discretion of VITYL 3DCP Decor, minus any costs already incurred. Custom orders cannot be returned or exchanged unless the product is defective or does not match the approved design specifications.

7. Intellectual Property
All designs, sketches, and concepts developed by VITYL 3DCP Decor are the intellectual property of VITYL 3DCP Decor. Any unauthorized reproduction or use of our designs is prohibited. The customer may use the final product for personal or commercial purposes, but they may not claim the design as their own creation or reproduce it without written consent from VITYL 3DCP Decor.

8. Warranty Disclaimer
All products are sold "as is" without any express or implied warranty of any kind, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. VITYL 3DCP Decor makes no warranty that the products will meet the customer’s specific needs beyond the specifications provided and approved during the design process.

9. Limitation of Liability
To the fullest extent permitted by law, VITYL 3DCP Decor shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the products, including but not limited to damages for loss of profits, goodwill, or other intangible losses. Our maximum liability, under any circumstances, will not exceed the amount the customer paid for the product in question.

10. Force Majeure
VITYL 3DCP Decor shall not be held responsible for any delays or failure to fulfill its obligations under these terms due to causes beyond its control, such as natural disasters, strikes, pandemics, transportation issues, or acts of government.

11. Compliance with Local Regulations
The customer is responsible for ensuring that the product they order complies with all local, state, and federal regulations applicable to their location. VITYL 3DCP Decor is not liable for any issues arising from non-compliance with such regulations.

12. Governing Law
These Terms and Conditions are governed by the laws of the state of Utah in the United States of America, without regard to conflict of law principles. Any disputes arising out of or in connection with these terms shall be resolved exclusively in the courts of the state of Utah in the United States of America.

13. Modifications to Terms
VITYL 3DCP Decor reserves the right to modify these terms and conditions at any time without prior notice. Customers are encouraged to review these terms regularly. Continued use of our services after modifications constitutes acceptance of the updated terms.
